THE AGREEMENT
This is an agreement between Paradise Beach Weddings (www.paradisebeachweddings.net) referred to as “PBW” and referred to as “Client”, and will be effective as of:
PBW will provide a service based on the extensive background in all expects of wedding planning and provide access to a full range of related product and service contacts.
PBW requires that at all wedding ceremony events, any additional vendors are selected from our preferred list of wedding service providers. These wedding service providers have demonstrated superb professionalism in building successful business relations with PBW and its clients. The only exception is photographers. You may also request approval for other outside vendors.
At reception events, Client may select from any vendors, but PBW will not be responsible for outside, non-approved vendors when were are hired in a reception planner role and executing prior to, and day of planning.
The Client has indicated that the couple will be getting married or having a ceremony of some type on the and requested the services of PBW.
The Client and PBW agree to the following:
SERVICES PROVIDED
Services provided will vary from wedding setups on the beach and other locations, this may include arches and other decorative options officiant services, photography, marriage license filing, ceremony music, wedding planning services. Since the range of services is broad, and often changes are made, the invoices from PBW, sent to and paid by the Client, will reflect the actual deliverable services from PBW to Client.
PHOTOGRAPHIC COPYRIGHT:
Should PBW or one of PBW’s subcontractors provide photography and photos of your ceremony/reception, PBW owns the original copyright to all images created. Unless otherwise noted, PBW gives permission to the Client to post photos online and make prints. The Client may use or reproduce the photos in any manner that they choose. The Client may not sell the photos.
Photographs are supplied to the Client on via a link in the cloud, usually within two weeks of the wedding date.
RATES, FEES and CANCELLATIONS/REFUNDS
BOOK A DATE:
You must Book a Date on our website get approval for that date/time as a first step. Once you have booked your date, we will review the date/time and either approve it, decline the booking, or contact you about conflicts or alternate times.
SECURITY DEPOSIT:
A $200.00 security deposit will be charged for each base package to cover late start times, ensure returns of rental items and any extra charges we may incur (parking, access etc). You may receive a refund of all or part of the deposit due (via check a few weeks after the ceremony) if you do not have excessive charges for items listed above in this paragraph.
WEDDING CEREMONIES PAYMENT SCHEDULE:
PBW requires the following payment schedule for all wedding ceremony engagements/invoices.
From 91 or more days in advance: 25% of estimates/initial invoice amounts or $250 if amount is not known.
From 31-90 days in advance: 50% of estimates/initial invoice amounts.
30 Days in advance: Payment in Full
Final payments plus applicable taxes, “Payment in Full” to Paradise Beach Weddings may be via a check received and cleared or credit card through secure payments using SSL and our website, invoicing system or via PayPal at least 30 days prior to your ceremony. Paradise Beach Weddings will supply a balance due Invoice for all services with payment link.
ALL WEDDINGS MUST BE PAID IN FULL BEFORE SET-UP BEGINS.
CANCELLATION POLICY/REFUNDS:
If you need to cancel your booking with PBW, your initial 25% payment is non-refundable (as well as $100 dave the date fee). We will refund a portion of your other payments made 46 days or greater from your booked wedding date. The exact amount will be calculated based on our time spent on hourly Wedding Planning services, meetings, calls, emails, texts, etc. and any special order items as noted in invoicing as mentioned above in SERVICES. No refunds for cancellations 45 days or less from booked wedding date. Refunds will be sent via check and the typical timing is two to four weeks, but can vary if events cause uncertainty, see IMPOSSIBILITY, FORCE MAJEURE below.
POSTPONEMENT/RESCHEDULE
In the event that the wedding or event needs to be postponed or rescheduled, we will work with you to find a future date that works for you The Client, for PBW, and your other venues, vendors etc. Any deposits made will be transferred without penalty to the new date and no “reschedule charges”. You have up to twelve months from your original booked to reschedule and still apply the paid deposits to the event. This includes inclement weather and hurricanes. If the event is not rescheduled and held with twelve months from original event date, the contract is null and void and no refunds will be issued.
IT IS THE RESPONSIBILITY OF THE COUPLE TO HAVE A “BACK-UP” LOCATION IN CASE OF INCLEMENT WEATHER
Unfortunately, we cannot control the weather. We will make every effort to have the ceremony on the beach. If we can wait out a storm for a short period of time, we will. But if we can’t, we will try and move the wedding to your reception venue (*additional travel fee may apply if your site is outside of Volusia County, Fl – *some decorations may not be able to be used at the alternate ceremony site). We are not responsible for finding you an alternative site. Some parts, or all of our set-ups might not be able to be installed during inclement weather. If there is a Hurricane Warning, we would be happy to reschedule the ceremony for another day (based on availability).
REHEARSALS/MEETINGS:
Most Beach Wedding do not require a rehearsal. We always provide a staff member to greet you in parking areas, boardwalks or safe place at the wedding location. We use walkie talkies to communicate down to the beach. However, if you feel more comfortable, we will be more than happy to meet with you at your beach location or other designated location. There will be a $125 rehearsal meeting fee in addition to your other invoice costs.
PHOTOGRAPHY TIME OVERAGE:
Often the photography time at the wedding and/or reception exceeds what the client has requested and paid for. The photographer will notify the Client if time is exceeded at the ceremony/reception and give the client the option to add additional time. In this event, any overage time spent beyond the stated and paid photography package will be billed after ceremony at the rate of $50 per 15 minute increment. No photographs will be released and provided to the Client until all invoices are paid in full. Also, late starts mean the photographer is spending time waiting. PBW reserves the right to bill time overage in 15 minute increments for late starts caused by the Client and guests.
TERMINATION:
PBW reserves the right to terminate the contract with written notice via email, fax, US mail or in person, in the event that Client does not comply with any of the following contract terms, does not make timely payments, or exhibits conduct that is not conducive to PBW’s business and livelihood. Refunds will follow the CANCELLATION POLICY/REFUNDS above, unless the termination is at the wedding site, on the wedding day and the LATE START or SAFETY terms violated.
PRICING POLICY:
Our prices are applicable to ceremonies in New Smyrna Beach, Ponce Inlet, Port Orange, Ormond Beach, Ormond by the Sea, Wilbur by the Sea, Palm Coast, Flagler Beach or Daytona Beach, Florida. A travel fee may apply to areas outside of our normal geographic territory. Prices may vary outside of the areas listed in above.
CHANGING YOUR ORDER:
If you would like to change your order, your total of the new order will be equal or greater than your order now. No changes may be made, except for chairs added, within a week of your ceremony. Extra chairs may be added 2 working days before your ceremony. No substitutions for items previously ordered.
LATE START:
Paradise Beach Weddings have agreed to provide services to you at the specified time. Everyone (including Bride and Groom) should arrive 15 minutes prior to the wedding time. Your guests also should expect that the wedding will start on time. Guests may be seated, gather around wedding site 15 minutes prior to the wedding time. Therefore, a late fee will necessarily be charged for any wedding that does not start within 30 minutes of the specified time. Over 30 minutes late will be assessed a $100 fee; 45 minutes or later a $150 fee, and any wedding that has not begun within 1 hour after the scheduled time may be cancelled and disassembled with no refund, at Paradise Beach Wedding’s discretion.
Your set-up is for an hour after your scheduled start time, this allows for your photographer to take pictures of you with your set-up. We strongly suggest at the end of your ceremony to have your photographer do this. Your set-up will be disassembled an hour after your scheduled start time.
MARRIAGE LICENSE:
Do not forget to bring your marriage license. We will execute and file your license unless you would like to file it yourself.
YOUR LICENSE WILL NOT BE SIGNED UNTIL FEES/INVOICES ARE PAID. AFTER 3 DAYS OF NON-PAYMENT, YOUR UN-SIGNED LICENSE WILL BE MAILED TO THE ADDRESS WE HAVE ON FILE.
PERMITS:
Beach Weddings in Volusia County, Florida that have less than 50 total in attendance do not require a beach use permit. Those weddings with 50 or more do require a beach use permit as well as liability insurance. This can be paid by the client or PBW, which would then invoice for the permit and insurance, and this will be determined through discussion with the client.
ENVIRONMENTAL:
If the wedding is at the beach, Volusia County has environmental rules around Turtle Nesting season (May1st-Oct 31st each year). This means no lights or equipment on the beach before sunrise or after sunset during this seasonal time. Also PBW has environmental rules. If you are using flower petals on the ground for decoration, they must be real flower petals. NO ARTIFICIAL PETALS are allowed. If Client or guests bring any items such as bubbles, fans, water bottles, streamers and other items, the Client and guests must dispose of the items properly in trash receptacles or by carrying off of the beach. PBW’s philosophy is the beach is to be left in better condition when we leave than when we got there to setup.
SAFETY:
It is imperative that a safe environment is provided for all Paradise Beach Wedding staff. Clients are responsible for restraining pets from ceremony area (Pets are not allowed on the public beach) and the officiant is not to have any interaction with pets unless approved in advance. If you do get married at the dog beach, (and we love dogs) we can discuss having your dog in the ceremony.
Drunken and unruly bridal party members and/or guests are to be kept away from the officiant. If at any time the officiant feels unsafe or threatened in any manner, or feels that the service can not proceed, they shall leave the ceremony location, regardless whether the services have been rendered in full, and the clients agree and understand that they will be responsible for payment in full of the fee under such circumstances, regardless of whether the ceremony was completed.
Client(s) further understand that PBW complies with all health and safety laws, directives, and rules and regulations. Client(s) expressly agree(s) that during the [event/wedding/session] Client(s) and Client(s)’ agents shall not carry weapons or firearms, be exposed to severe illness, or request the PBW to do anything illegal or unsafe. Further, PBW will not provide services in any location or area deemed to be unsafe in its sole discretion, including, but not limited to, areas affected by communicable diseases, quarantined areas, or other similar occurrences. Under any of these circumstances, PBW reserves the right to end service coverage immediately and/or leave the [event/wedding/session]. PBW shall be entitled to retain all monies paid and Client(s) agree to relieve and hold PBW harmless as a result of incomplete event coverage, or for a lapse in the quality of the PBW work.
IMPOSSIBILITY
FORCE MAJEURE
No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make payments to the other party hereunder), when and to the extent such failure or delay is caused by or results from acts beyond the impacted party’s (“Impacted Party”) control, including, but not limited to, the following force majeure events (“Force Majeure Events”): (a) acts of God; (b) a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, explosions, infestations), epidemic, or pandemic; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; and (i) shortage of adequate power or transportation facilities. The Impacted Party shall give Notice within days of the Force Majeure Event to the other party, stating the period of time the occurrence is expected to continue. The Impacted Party shall use diligent efforts to end the failure or delay and ensure the effects of such Force Majeure Event are minimized. The Impacted Party shall resume the performance of its obligations as soon as reasonably practicable after the removal of the cause. In the event that the Impacted Party’s failure or delay remains uncured for a period of days following Notice given by it, the other party may thereafter terminate this Agreement upon Notice.
FAILURE TO PERFORM SERVICES
In the event PBW cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:
- Immediately give Notice to Client via the Notice provisions detailed in this Agreement; and
- Attempt to find another competent professional to take its place with the mutual agreement of Client(s);
- If another competent professional is not available or Client(s) do not agree to transfer of obligations to said alternate professional, Company will issue a refund or credit based on a reasonably accurate percentage of services rendered; and
- Excuse Client(s) of any further performance and/or payment obligations in this Agreement
ENTIRE AGREEMENT:
This agreement contains the entire agreement of the parties. This agreement supersedes any prior written or oral agreements between The Client and PBW. Only invoices from PBW to client will have supporting services information that support this SERVICES PROVIDED section above on this agreement.
SEVERABILITY:
If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
WAIVER OF CONTRACTUAL RIGHT:
The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Agreement.
APPLICABLE LAW
This Agreement shall be governed by the laws of the State of Florida and Volusia County.
